Trevor Noah was right. Trump really does want to be dictator of a third-world kleptocracy.

Clearly this deals with issues of discrimination, of privacy, of autonomy that have been laid out in dozens of previous SCOTUS decisions.

Unfortunately I suspect that the right wing majority will decide this on their own policy preferences and their own bigotry - just like they did in Dobbs.

Actually FBI background checks of potential appointees require voluntary cooperation of the applicant. The potential appointee has to fill out a form granting permission, and providing basic information to start (financial, personal, employment, affiliations, etc).

It isn't clear from the stories on this whether Trump and his team will be requiring appointees to consent to a FBI evaluation, or what the consequences would be if they don't. (Normally the response would be "thank you for your interest, but without this background check you can't be named to this position"

Of course, the Senate can order their own background check from the FBI.

-They’ll use the FBI to investigate anyone they deem an “enemy” to Trump, and they’ll either justify it slowly, little-by-little or go full blast in conflating negativity towards Trump as being a potential “threat” to the country itself.
