This is exactly how I think federation should be handled. Great policies as always. I've just blocked any instances that have been too annoying so far.
If a user doesn't agree with how an instance does things, they can (and should) just move to another instance that fits their needs. There are tools already to transfer an account's subscriptions, until this feature is made native like in Mastodon.
If someone going to get sued for it. It will be dbzer0.com and lemmy.ml due to said communities being part of the instances not LW.
Don't instances cache the content from federated instances? I can still view content from vlemmy.net from other instances, even though it's been permanently shut down.
Doesn't matter if they are hosted here or not. The way federation works is that threads on different instances are cached locally.
We have NO issues with the people at db0 - we are just looking out for ourselves in a 'better safe than sorry' fashion while we find out more. As mentioned in the OP we would like to unblock as soon as we know we can not get in any legal trouble.
Reddit has gotten into legal trouble numerous times regarding r/piracy, despite it not hosting any copyrighted material either.
Why is anyone complaining about instances not taking the same legal risks as a massive corporation? Just use another instance that fits your needs.

I wouldn't take the risk federating with legally questionable instances, and no one should have to. I'd just use an alt account for that on another instance that is federated, and I do.

That doesn't seem to be the case. vlemmy.net has gone down permanently it seems, and I can still access the content on there that were made while it was up from other instances.
Hasn't reddit already gotten into legal trouble multiple times regarding that sub? Even very recently with film piracy.
And let's not pretend these communities only 'discuss' piracy, as much as they try to keep it within that limit. These corporations wouldn't care even if they did.
