‘Kill the Bill.’ BC Faces Mounting Pressure Against Bill 15

  • The class action was filed in November 2022, two weeks after a landmark decision by Quebec Superior Court Justice Michel Yergeau in a case seeking to have a common law rule allowing Canadian police to stop drivers for no reason to be declared unconstitutional.

Yergeau sided with Joseph-Christopher Luamba, a Montrealer of Haitian descent, ruling racial profiling exists and is a reality weighing heavily on Black people.

Yergeau's ruling effectively nullified Section 636 of the province's Highway Safety Code, which gives officers discretionary power to stop any vehicle without reason.

Excellent ruling. Cops shouldn't be able to stop anyone without cause.

  • Canada has a history of separatists, most notably Quebec who held two referendums on the issue.

The first (in 1980) was rejected by 60% of Quebec voters. The second (in 1995) was extremely close -- 50.6% to 49.4% against separation.

After the last vote the Quebec separatist movement seemed to die down a bit.

While we should pay attention to what some Albertans say on the issue I am hopeful that others will look to Brexit and Quebec for teachable moments.

  • Files documenting the worst abuses at residential schools are set to be destroyed in 2027 and, despite a multi-year outreach, some survivors say they didn't know they could opt to have their files preserved.

Of the 38,000 people who filed claims with the IAP, 90 per cent had a hearing or settlement negotiation, according to the IAP website.

The process was made confidential so survivors would be comfortable sharing painful and personal details. It also meant that any people associated with the schools who were accused of abuse would not have those details made public.

The question of what to do with the files afterward arrived at the Supreme Court in 2017. The NCTR and the Canadian government opposed the destruction of the files, while many Catholic organizations, lawyers who acted for IAP claimants and the Assembly of First Nations supported destroying them.
