So much of our government requires people to have ethical values. People like Thomas, Alito and Trump weren't expected.
- Those sorts were expected. The issue is congress willingly allowed the executive to slowly siphon away the vast majority of their power.
- It's disappointing because we really SHOULD have collectively, and historically, known better.
  Nobody told me this growing up, but I the actual American dream was that people could just be decent. We were wrong. And that's why there's no United to Stand on anymore. We need so figure it out.
  
  One side is largely decent. The other thinks transgender people are pedophiles and attempt coups.
I assume the response from SCOTUS will be along the lines of "fuck you, we do whatever we want and no one can stop us" in legalese.
That would require him to be ethical. No shot.
The trick is, when Alito says Congress didn't create the Supreme Court, he's not wrong.
The court was formed by the Constitution, just like the Legislative and Executive branches.
The problem is that there is no check and balance on court power. Yes, the Executive nominates judges and the Legislative confirms them.
Other than impeachment, there's no other control over the court. It's not like the Executive or Legislative can reverse a ruling they don't like.
Changing the way the court works would involve either an Amendment, or a full blown Constitutional Convention, neither of which we have the political will to get done.
- Congress has plenty of indirect power over the court, but congress is also the most broken part of the government and the reason why the supreme court feels illegitimate. The system is working as designed, the issue is that people have been voting against their own interest for decades. The fact we have to rely on the supreme court to legislate is the main problem.
